The 9th U.S. Circuit Court of Appeals in San Francisco said users would be able to pursue the claims under “federal and California privacy and wiretapping laws,” according to the article. Initially, U.S. District Judge Edward Davila in San Jose dismissed the suit in 2017, stating users lacked standing to pursue damages. However, that decision was overturned after a three judge panel decided users had a “reasonable expectation of privacy, and had sufficiently alleged a ‘clear invasion’ of their right to privacy.”
