Reportedly, Griffin demanded the names of the students in an effort to facilitate shaming them, but U.S. District Court Judge William Bertelsman held Griffin’s actions on Twitter cannot be considered to have taken place in Kentucky, and therefor she is not subject to the jurisdiction of its federal courts.
The students, from Kentucky, argued a Kentucky court should have jurisdiction over Griffin since she called for the state’s citizens to take action against them, but that argument was rejected on the grounds a “defendant must be present in Kentucky when starting an action that causes a tort,” according to the article.
