Attny Ted Frank: Subway 'Footlong' Settlement Shorts Paintiffs

A federal appeals court panel will assess if a settlement between Subway restaurant owners Doctor’s Associates Inc. and consumers favors the lawyers involved in the case too heavily. So reports The Wall Street Journal.

Subway was involved in class-action settlement after it was accused of misleading consumers by advertising a “footlong” sandwich that was not a full foot in length. A district court judge approved $520,000 in plaintiffs’ attorney fees to be divvyed among several firms as well as incentive awards of $500 each to 10 named plaintiffs.

Competitive Enterprise Institute litigator Ted Frank argued the settlement doesn’t benefit the plaintiffs enough.
