Prosecutors: Sentencing Judge Shouldn’t Consider Tragic Death of Criminal’s Young Son

Federal prosecutors urged a sentencing judge to hand down a hard sentence to an admitted Brooklyn bank robber despite the fact that the criminal’s 6-year-old son was stabbed to death in an unrelated incident two years after the crime. So reports The New York Daily News.

The prosecutors pointed out several infractions by the criminal, Nicholas Avitto, when they argued that he should be punished within the sentencing guidelines, which range from 10 to 12 years in prison. Prosecutors further said the depression that Avitto experienced as a result of his young son’s death did “not constitute extraordinary circumstances sufficient to award acceptance (of responsibility) points,” which would reduce the sentencing guidelines.
