Justice Dept: Denying Transgender Prisoner Hormone Therapy Is Unconstitutional

The Justice Department filed a “statement of interest” supporting a transgender prisoner’s lawsuit against the state of Georgia for discontinuing the hormone therapy she has been taking for the last 17 years. So reports The Los Angeles Times.

The prisoner, 36-year-old Ashley Diamond, has been diagnosed with gender dysphoria. Diamond’s lawyers say that terminating her hormone therapy has caused her body to undergo severe changes, and that Diamond has attempted suicide and castration as a result.

The Justice Department’s filing argues that Georgia’s policy for treating prisoners, which does not require independent assessments of prisoners’ conditions, violates the Constitution’s prohibition against cruel and unusual punishment.
