Victims Sue Houston Over Untested Rape Kits, Judge Tosses Suit

Two rape victims who sued Houston officials for allowing a backlog of untested rape kits to accumulate, had their case tossed by a federal judge. So reports a Chron.

The plaintiffs say the backlog allowed their attackers to avoid prosecution. Both women were raped by serial offenders whose DNA had been in backlogged police databases.

The plaintiffs said their rights to due process and equal protection were violated. However, U.S. District Judge Vanessa Gilmore said the suit was not filed quickly enough and their claims were not protected by the Constitution.
