The girl, Lexi, is part Choctaw. Per the federal Indian Child Welfare Act, she is being moved to live with nonblood, extended relatives of her biological father, said her foster parents Rusty and Summer Page. They have launched on online petition in protest and it has gained more than 40,000 signatures.
The family’s attorney said they have appealed to the California appellate courts and expressed disappointment that the child was taken while the case was still pending. The family is prepared to take the case to the Supreme Court, but cannot until a ruling is rendered in California.
