Kesha sent an unsubstantiated text message to Lady Gaga that Dr. Luke raped recording artist Katy Perry. Further, the judge rejected Kesha’s argument that Dr. Luke is a “public figure,” which means Gottwald’s lawyers won’t need to prove Kesha acted with “actual malice” or “gross irresponsibility.” The judge also ruled Kesha breached a contract with KMI, Gottwald’s company, by way of late royalty payments and was ordered to pay $374,000 in interest.
