High Court Says Facebook Rant Not Enough for Prosecution

A Pennsylvania amusement park worker who made Facebook threats to his ex-wife will have his conviction thrown out, per a recent Supreme Court decision.

Anthony Elonis will have his conviction chucked based on an interpretation of criminal law from the nation’s high court. So reports NBC News.

The court said that the perception of the threat by the recipient is not enough for a conviction, which was based on a federal prohibition on transmitting threats to harm someone. The mental state of the person making the threats must be considered, according to the court. The case did not consider the First Amendment.
