Attorney Kimberley Motley, representing the family, said they are planning to file a federal lawsuit against Wauwatosa Police Officer Joseph Mensah.
Mensah said Cole had a gun, fired it, and refused to drop the weapon when commanded. Cole is the third person Mensah has killed since joining the police in 2015.
