Mass. Landlords Challenge Constitutionality of Eviction Halt

Massachusetts landlords are challenging the state’s eviction moratorium put in place during the COVID-19 pandemic. So reports the Associated Press.

final 4896425 640Landlords filed the federal lawsuit challenging the constitutionality of the moratorium, which was recently extended through mid-October by Gov. Charlie Baker. “The moratorium violates the constitutional right to petition the judiciary; the right of free speech under the First Amendment; the right to just compensation for an unlawful taking of their property under the Fifth Amendment; and is an unconstitutional impairment of their leases,” argued attorney Richard Vetstein, per the article.
