Fijalkowski, who was working as a pool attendant in Virginia, claims the police officers and lifeguard on duty were too slow and did not do enough to help him. Fijalkowski reportedly held himself underwater for more than two-and-a-half minutes before police saved him.
The pool company said the police officers told the lifeguard to stay put until they saw Fijalkowski stop moving. He has since returned to Poland and claims he has more than $100,000 in medical expenses.
