Lawyer Inquires About De Facto Dismissal for Case Dragging 500 Days

A lawyer in the New Jersey case challenging the constitutionality of revoking a driver's license for not making child support payments is questioning how long a delay can be considered a de facto dismissal. So reports Above the Law.

Mercer County Assignment Judge Mary Jacobson has sat on the case for more than 500 days. David Perry Davis, who is representing the plaintiff in Kavadas v. Martinez, inquired if the case is now eligible for appellate review as a result of the delay. Jacobson indicated a ruling was imminent in September, but never issued one.
