A five-judge appeals panel tossed out a $27.5 million lawsuit filed by injured British tourist Sian Green, agreeing with a lower-court ruling that Green was unable to provide “facts sufficient to show a special duty owed by the city to her.” So reports The New York Post.
Sian, a former “beauty queen,” lost her leg when she was hit on a sidewalk in Manhattan four years ago. Green claimed the NYC Taxi & Limousine Commission was aware the driver was permitted to drive the cab, despite numerous penalties, due to a computer malfunction.
