Death Row Prisoner: Expert Testimony was Racially Charged

The Supreme Court is expected to side with a black Texas prisoner, Duane Buck, who argued he is entitled to a new court hearing in his death sentence case after an expert witness testified his race makes him more likely to commit another crime. So reports the Associated Press.

The Supreme Court could instruct a lower court to decide if his death sentence should stand, or could throw out his sentence and order a new punishment hearing. Buck's case was one of six cases that featured "racially charged" testimony from Dr. Walter Quijano, who was called by the defense during Buck's trial. New punishment hearings were held in the other five cases and each convict was, again, sentenced to the death penalty.
