DWI Charges Dropped Against Woman Who Suffers From Rare Disorder

In what a defense attorney called “one of the strangest cases [he’s] ever been involved with,” a judge dismissed driving while intoxicated charges against a woman who has a disorder that turns ordinary food into alcohol in her body. So reports The Buffalo News.

The woman, whose name has not been published, was prosecuted in New York State after cops stopped her on the road and her blood alcohol content registered at .33%, more than four times higher than the state’s legal limit.

The woman claimed she’d only had three drinks—not enough liquor to produce such an high blood-alcohol reading—and her attorneys successfully proved that she suffers from disorder known as auto brewery syndrome. Doctors says people who suffer with the condition often can function normally despite the amount of alcohol in their systems, and that fewer than 100 people have been officially diagnosed with the illness.
