The man, Hiram Jimenez, heard a popping noise and felt a burning sensation on his face after he’d bent close to the table to pray over the sizzling skillet. The two-judge appellate court panel held that Applebee's "had no duty to warn (Jimenez) that the food was sizzling hot and should be approached with due care" because the risk posed by the skillet was "self-evident."
