Court Extinguishes NY Smoking Ban

A court last week permanently blocked the enforcement of a regulation banning smoking in 179 outdoor New York State parks and 35 of the state's historic sites, including swimming beaches, picnic areas and boardwalks. So reports Bloomberg.

The court held that New York's Office of Parks, Recreation & Historic Preservation exceeded its authority when it passed the ban in February because the ban amounted to legislation “regulating conduct bearing any tenuous relationship to park patrons’ health or welfare," and state law only permits that office to conduct "interstitial rule-making."
