Booth, a city lawyer, made 600 objections during the deposition of Essig in relation to a “false arrest and malicious prosecution” case. Despite a warning from the law clerk regarding the appropriateness of the length of Booth’s objections, they went on for eight hours and comprised 83% of the transcript.
Brooklyn Federal Magistrate Judge Cheryl Pollak said the city should foot the bills related to the deposition after opposing counsel complained about the matter.
