Corrections Officer’s Circumcision at Heart of Sexual Assault Suit Dispute

A dispute over the value of a Rikers Island inmate’s description of a corrections officer’s genitals has erupted. So reports The New York Daily News.

The unnamed inmate accused Correction Officer Benny Santiago of sexual assault. She claims her ability to identify that he has an uncircumcised penis and alleged semen he wiped on her pants will prove her case. However, the city medical examiner did not find evidence of any semen, according to the article. Lawyers for the woman allege evidence may have been tampered with.

Santiago disputed the woman’s description of his penis is meaningful evidence he assaulted her since there is a “50% chance of getting that right.” The judge overseeing the case said a physical examination of Santiago’s genitalia would be insufficient to identify him and would invade his privacy.
