Calif. Law Changes Definition of Consent on College Campuses

California has adopted a law requiring colleges in the Golden State to apply the “yes means yes” standard when investigating allegations of campus sexual assault. So reports USA Today.

 

The Bill defines consent as "an affirmative, unambiguous and conscious decision" by each party engaged in a sexual activity. This standard is meant to offer more protection to sexual assault victims than the “no means no” standard, which would allow college investigators to interpret silence, lack of resistance, or drunkenness as consent.
